Pre-file Investigations

A pre-file investigation is a criminal defense investigation that takes place before formal charges are filed against a suspect

  • Purpose

    A pre-file investigation is a proactive step to gather evidence and influence the prosecutor's decision. The goal is to prevent charges from being filed, or to reduce the severity of the charges. 

  • What happens

    A criminal defense attorney will investigate the allegations, interview witnesses, and gather evidence. They may also consult with experts, such as forensic investigators. 

  • Outcomes

    The prosecutor will decide whether to file charges, close the case, or request more investigation. If charges are filed, they may be less severe than originally anticipated. If the case is closed, it may be because the defense attorney was able to provide an alibi or other evidence that clears the suspect. 

  • When to hire a lawyer
