Post-Conviction Relief
Post-conviction relief is a legal process that allows a defendant to challenge the legality of their conviction or sentence after a judgment has been made. There are several types of post-conviction relief, including:
PCR application
The most common type of post-conviction relief
Habeas corpus petition
A legal petition that challenges the legality of a defendant's imprisonment or conviction. This can be based on new evidence, prosecutorial misconduct, or ineffective assistance of counsel.
Motion for new trial
A request to have the case reheard before a new jury. This can be based on new evidence or prosecutorial misconduct.
Motion to vacate judgment
A request to set aside a conviction due to constitutional violations, ineffective assistance of counsel, or other legal errors.
Expungement
A process that allows a defendant to petition to have their criminal record expunged after successfully completing probation. The case will be dismissed and the defendant will not need to disclose the expunged case to future employers.
Early termination of probation
A request to the court to grant early termination of probation if the defendant has completed their probation requirements.
