AREAS OF PRACTICE
NEW JERSEY CRIMINAL PRACTICE
The New Jersey Courts Criminal Practice Division develops and implements policies and best practices for criminal justice. The Criminal Practice Committee is an independent branch of government that is responsible for resolving disputes fairly and justly.
Here are some aspects of criminal practice in New Jersey:
Criminal cases
Involve a defendant accused of a serious crime, such as murder, theft, robbery, or drug possession.
Criminal process
The prosecutor represents the state and tries to prove the defendant's guilt. The defense attorney represents the defendant, and the judge oversees the proceedings.
Plea bargains
Most criminal cases are resolved through a plea bargain, where the defendant pleads guilty in exchange for a less severe sentence.
Criminal justice reform
New Jersey has implemented a risk-based bail system that detains defendants who are a serious risk of flight or danger, while releasing low-risk defendants who can't afford bail.
Criminal justice programs
These programs include court appearances, drug testing, detoxification, residential programs, counseling, and community service.
Rights of the accused
The New Jersey Constitution guarantees the accused the right to a speedy and public trial, to be informed of the charges, and to be confronted with witnesses against them.
